Do Houston landlords have to waive pet rent for an ESA?
Yes, when the accommodation is approved. An approved assistance animal is not a pet under the Fair Housing Act, so pet rent, pet deposits and pet fees do not apply anywhere in Houston or unincorporated Harris County. You remain liable for any damage the animal actually causes.
My Houston complex says deed restrictions override my ESA letter. Is that right?
No. Deed restrictions and HOA covenants are private agreements; they do not displace federal fair housing obligations. A deed-restricted rental in Harris County is still subject to the Fair Housing Act, and a blanket breed or weight restriction generally cannot be applied to an approved assistance animal.
